1. Purpose and acceptance

These terms of use govern access to and use of the aiKip platform, an online application-management service (ATS) reserved for professionals. The financial terms (subscriptions, payment, cancellation) are governed by the Terms of Sale. The authorized account creator accepts the terms during signup. The Customer makes them available to invited Users and ensures their compliance; continued use does not by itself establish acceptance of every future amendment.

2. Service publisher

aiKip is published by Axel Gilbert, sole trader, SIREN 923 027 155, whose registered office is at 5 rue Valentina Terechkova, 31400 Toulouse. Full identification appears in the legal notice.

3. Hosting

Candidate data is hosted in France on Scaleway’s fr-par infrastructure. Processing purposes, approved subprocessors and safeguards are specified in the DPA and privacy policy. Separate billing and payment processing is described there as well. This hosting commitment does not certify the Customer’s own systems or recipients to whom it independently exports data.

4. Accounts and access

Access is reserved for professionals who have created an account. The account holder is responsible for the confidentiality of their credentials and the actions taken via their access, including those of the team members they invite (Admin, Recruiter, Viewer roles). Creating an account opens a 30-day free trial with no commitment and no credit card.

5. Permitted and prohibited uses

The user undertakes to:

  • use the platform to manage genuine recruitment for their organization or authorized principals;
  • collect applications fairly and inform candidates in accordance with the GDPR (the aiKip application form displays a versioned privacy notice and records that it was shown); the Customer acts as data controller of the candidate data and is responsible for having a lawful basis, informing candidates, carrying out a data protection impact assessment where required (art. 35 GDPR) and applying the applicable retention limits;
  • maintain a human review of every application: the AI score is a decision-support aid and cannot, on its own, ground a shortlisting or rejection decision (EU Regulation 2024/1689 — see AI Transparency);
  • not attempt to circumvent their plan limits or the security mechanisms;
  • not use the platform to collect data unrelated to recruiting, post fictitious jobs, or any discriminatory or unlawful use.

In the event of a serious breach, the Publisher may suspend the account after notice, then terminate it under the conditions set out in the Terms of Sale.

6. Service availability

aiKip undertakes to implement the means necessary to ensure the availability of the service, without an obligation of result. Planned interruptions are carried out, as far as possible, outside French business hours.

7. Personal data

The DPA applies from account creation, including the free trial, before any candidate data is processed.

The processing of personal data is detailed in the privacy policy, the GDPR page and article 7 of the Terms of Sale and the public DPA (processing, art. 28 GDPR). The use of artificial intelligence is described on the AI Transparency page.

8. Intellectual property

aiKip's code and visual identity remain the property of the Publisher. Content published by the user (jobs, employer brand) belongs to them; they grant aiKip a technical use license limited to operating the service.

9. Amendment of the terms

The Publisher may amend these terms. Any substantial change is notified to users at least 30 days before it takes effect.

10. Governing law

These terms are governed by French law. The jurisdiction provision in the Terms of Sale applies only where article 48 of the French Code of Civil Procedure permits it.

11. Users and recruitment scope

The Customer is the organization holding the workspace; a User is an individual it authorizes. The person creating the workspace represents that they have authority to act for the Customer. Agencies may manage recruitment for their principals where the necessary authority and data-protection arrangements exist. Accounts must not be transferred or shared among unidentified individuals.

Candidates do not subscribe to a paid service by applying. Their access to forms, tracking and personal data is governed by the notices presented in the candidate journey. The Customer remains responsible for its vacancies, communications, response times and decisions. aiKip is neither the candidate’s employer nor an agency guaranteeing placement.

12. Jobs, pipeline and teamwork

The service supports job creation and management, application intake and import, candidate records and documents, pipeline stages, assignment and notes. Views, filters, statistics and exports reflect available data and the User’s permissions; they are neither certified accounts nor exhaustive evidence of a recruitment process.

The Customer checks that vacancies, working conditions, compensation and criteria are genuine and lawful. It updates jobs, removes closed positions and checks message recipients. Roles must follow need-to-know access and unnecessary accounts must be promptly revoked. Authorized actions may change records or trigger messages and must be checked before confirmation.

13. AI scoring, CV extraction and assisted writing

AI may extract CV information, suggest a summary, points to discuss, an indicative score out of 100 and criterion evaluations, or draft a job description. Outputs are probabilistic and may be incomplete, incorrect, variable, biased or unavailable. A score is neither a probability of success, a certification of skills nor a judgment of a person’s value.

Before use, the User checks the analysis against the original document and relevant job requirements. An absent score or analysis error does not justify rejection. Scanned, complex or very long files may be poorly read; part of the text may be truncated for analysis. Current upload limits include 10 MB per CV; formats and other restrictions are stated at upload.

Human review must be meaningful: the User must be able to challenge, supplement and depart from the output. The Customer must not set a threshold that alone determines rejection or hiring, or use the tool to infer sensitive characteristics or discriminate. It trains AI users and follows applicable transparency and oversight instructions.

Generated drafts must be reviewed, corrected and approved before publication; no exclusivity or absence of similarity to third-party text is guaranteed. Administrators can disable candidate AI analysis. The Publisher’s own obligations for operation, security and system compliance remain applicable and are not transferred to the Customer by these precautions.

14. Career site, customization and domain

Depending on the plan, the Customer can adjust its logo, colors, text and layout in the visual editor and use a subdomain such as career.your-company.com. Customization uses available components and options; it does not include bespoke development or an exact reproduction of another website.

The Customer holds the necessary rights in its domain and content. It purchases and renews the domain, configures the required DNS records and keeps them valid. Activation depends on DNS verification and certificate provisioning; propagation and registrar availability are outside aiKip’s control. The domain remains the Customer’s after termination.

Published pages are public and may be indexed or temporarily stored in external caches. The Customer must not publish confidential or candidate data there. Deletion in aiKip does not immediately remove copies already held by independent search engines.

15. Distribution and job visibility

Current distribution includes the career page, Google for Jobs compatible JobPosting markup and an XML Atom feed of published jobs. Markup prepares a job for possible indexing; Google alone decides eligibility, ranking, display and timing. No number of views, applications or hires is guaranteed.

The XML feed is available by link and points to job pages. Availability does not mean automatic transmission to a partner. No other jobboard publication connector is active in the current offering. Partnerships may be introduced later under their own terms; a roadmap mention is not a delivery commitment.

16. Messages, interviews, imports and assistance

Messages, templates and scheduling tools facilitate communication; they do not guarantee email delivery, reading or attendance. Spam filters, incorrect addresses and recipient outages may prevent delivery. The Customer checks addresses, time zones, times and message content and uses alternative contact methods when needed.

Imports require permitted files and lawfully collected data and may require corrections or duplicate handling. The Customer checks results before use. Exports are technical records, not certification of a candidate’s statements.

The conversational assistant and help resources provide general product guidance. They do not replace legal advice, emergency assistance or a Publisher decision amending the contract. Users must not submit secrets, credentials or candidate data unnecessary to their request.

17. Data, confidentiality and safe use

The Customer limits collection to recruitment needs, informs individuals and handles rights requests with the assistance set out in the DPA. Processing needed for an application must be distinguished from optional talent-pool retention. That optional retention requires a separate choice; refusal must not prevent an application.

The Customer must not upload sensitive data, identity documents or criminal-conviction information without necessity and an appropriate legal basis. It checks applicable retention periods and must not treat deletion mechanisms as permission to retain everything until the longest possible deadline.

Each party protects confidential information received from the other, uses it only for the contract and restricts access to authorized persons subject to confidentiality. This does not cover information lawfully public, already known or independently obtained; legally required disclosure is limited to what is necessary. The DPA prevails for personal data.

Users maintain their browsers, secure devices and promptly report compromise to aikip.fr/contact without sending passwords. Malware, access-control bypasses, mass scraping, spam, unauthorized resale and intrusive testing without written permission are prohibited. Good-faith vulnerability reports may be submitted without exploitation or access to third-party data.

18. Technical limits and reporting

Access requires an Internet connection and a compatible browser. Operations may be queued, rate-limited or interrupted to protect security and availability. Included AI use covers recruitment for the Customer and its authorized principals; it is not an unlimited computing API or a processing service for resale.

Restrictions must be proportionate, explained where security and law permit, and removed once their cause is resolved. The Customer may challenge them through support. Unlawful content may be reported with its address, facts and reporter contact details; the Publisher reviews reports and takes appropriate measures.

The Customer keeps originals needed for its activity and checks exports. This precaution does not release the Publisher from its security, backup and restitution duties. Remedies, suspension conditions and liability limits are set out in the Terms of Sale, subject to mandatory law.
